TERMS, SERVICES, AND CONDITIONS

The Terms and Conditions listed below is an agreement to your use of our Telehealth Services and constitute a legal agreement between you as a user of the Services and Therapy On Call also known as TOC that is under Center For Integrated Care Marriage and Family Therapy, INC that will also be referenced as “We” which is not limited to the Clinicians, Administration Staff, or Providers at the organization. “You” is referred to Users that will be using our services or registered with us. “Clinicians” include Therapists, Interns, Supervisors, and any Service Providers.

Our Treatment Providers may include, but are not limited to, Licensed Clinical Social Workers, Licensed Marriage and Family Therapists, Marriage and Family Registered Interns, and Associate Social Workers who maintain an active license or registration in their resident state that they provide services.

USE OF THE SERVICES IS NOT FOR EMERGENCIES. IF YOU THINK YOU HAVE A MEDICAL OR MENTAL HEALTH EMERGENCY, OR IF AT ANY TIME YOU ARE CONCERNED ABOUT YOUR CARE OR TREATMENT, CALL 911 OR GO TO THE NEAREST HOSPITAL.

IF YOU ARE CONSIDERING OR CONTEMPLATING SUICIDE OR FEEL THAT YOU ARE A DANGER TO YOURSELF OR TO OTHERS, YOU MUST DISCONTINUE USE OF THE SERVICES IMMEDIATELY, CALL 911, OR NOTIFY APPROPRIATE POLICE OR EMERGENCY CONTACTS SUCH AS ACCESS 1-800-854-7771 OR 1-800-SUICIDE.

By registering and accessing services, the website, or any other portion, you are obligated by the governing laws and regulations. If you are in disagreement of the Terms, you will deny access or use of the Services for any reason. Access to this site and any other third party organization is restricted to our registered users and their Authorized Representatives ONLY.

Therapy On Call platform utilizes other third party organizations that are HIPPA compliant platforms that allow for online services, however We are not liable for their programs, information shared, and any other items they may present with an issue. Another third party that is also HIPPA compliant will also be used for the online portal to store user information and communicate with your Clinician. The Site TOC will also use a third party payor that will securely store payment information in their secured website that is protected. We do not hold any liability for third party secured sites and their transmissions.  

SERVICES

  1. Online Therapy Services can involve electronic or phone services with Clinicians.
  2. Users must be a resident of the State Clinician is authorized and approved by governing laws.
  3. Services can include individual, family, couple therapy as long as all parties consent to treatment.
  4. Consent Forms, Questionnaires, Personal information, and Payment will be completed by User prior to services rendered.
  5. Services must be rendered in a secluded, isolated place where confidentiality can be kept for both parties.
  6. Counseling sessions through the platform are NOT recorded.

THE SERVICES DO NOT INCLUDE THE PROVISION OF MEDICAL CARE AND/OR MEDICATION EVALUATION/SUPPORT.

We advise you to always seek the advice of a physician or other qualified healthcare provider with any questions regarding your personal health or medical conditions. Never disregard, avoid, or delay in obtaining medical advice from your doctor or other qualified healthcare provider because of something you were told by any of our Clinicians. If you have or suspect that you have a medical problem or condition, please contact a qualified healthcare professional immediately.

Payment policies

User agrees to pay in full sessions prior to rendering of Services through HIPPA secure site that is authorized to take payments for Therapy On Call. Our services are Direct Pay without Insurance in order to meet immediate, high demand for services in the convenience of their home at the time that works best for them.

For missed sessions there will be a fee of $30 if you DO NOT cancel a scheduled appointment  within 24 hours.

Any payment processing accounts with third parties will appear in your profile and will be able to view such payments on that site. You are responsible for any telephone or internet services charges on your end that may occur in accessing your account through the Services.

If you would like to use your insurance for these services, you will need to first contact your insurance company to see if you qualify for Telehealth services and then contact our main Office number 323-538-0975 to schedule with the office staff for these services. Therapy On Call is only a services that meets demands for your convenience at your selected time that is directly paid to the Site.

In order for you to access our Services, you must provide us with a current and valid email address and you agree to keep your email address updated.

There is no guarantee that you will accepted as a patient by our Clinicians. Although you may be initially accepted as a patient by our Clinicians, the Clinician may determine that telehealth counseling services are not appropriate for your treatment need and may elect not to provide telehealth counseling services to you through Therapy On Call at the Clinician’s sole discretion. You also have a right to cancel services at any time with prior notification to the Clinician or request another Clinician.

Registration Access

In order to register services through Therapy On Call, you must be of legal age of 18 years old or older, however for anyone under the age of 18 will need an authorized representative 18 years old or older in order to enter into a binding contract. If you register as the representative on behalf of the minor, you are fully responsible for adherence to our Terms and Privacy Policy.

Parents who are separated both need to consent if there is joint legal custody. Otherwise the parent with full legal custody can consent for the minor. Custody orders must be uploaded to your profile prior to receiving the service. Minors 12 years old or older can consent for their own treatment, however need a parent or legal guardian to register on their behalf.

You agree that you will be solely responsible for protecting and maintaining confidentiality of your password and not to disclose information to any third party. You will also be responsible for any activities or usage taken under your account, whether you have authorized such actions or not. You must notify us immediately if you know or suspect that any unauthorized person is using your password or your account, whether you lost or got stolen this information and your account may be accessed without your permission. We recommend that you DO NOT use our services on public computers nor store or save your password.

You agree that any information that you provide to us at all times or that you upload to Therapy On Call and affiliated third parties is true, accurate, and current and that any changes will need to be made immediately. You also consent to truthfully answering the questionnaires and any additional questions asked on the Site or by the Clinician to the best of your knowledge and ability. By creating an account you are consenting to the use of electronic means to receive these Services and Therapy On Call and Center For Integrated Care Marriage and Family Therapy INC. will not be liable for any loss or damage arising from your failure to comply to these terms and conditions. We are also not liable for the Clinicians who in their best practices are conducting services that are in your best interest.

Users agreed to abide by all local, state, national, and foreign laws and regulations in relation to your use of our Services. Users are restricted from uploading, posting, emailing, transmitting any content that is unlawful, unauthorized, violates privacy and rights of others, other personal data that is not related to treatment, false information, advertisements, and interrupt any content on the Site.

Clinicians

The Online Service Website may include profile information about our Clinicians and their areas of specializations, certifications, and education. Clinicians are solely responsible for the content of their profiles and disclaims any liability for the content including the accuracy of any information contained therein.

Users agree they WILL NOT use any of our Clinicians profile information for any other use other than services being rendered through the Site.

Clinicians are certified with the Board of Behavioral Sciences and agree to maintain their license to current and valid status. Interns are under the Supervision of a Licensed Clinician. We are not responsible for credentialing Clinicians and any liability for fraudulent credentials or claims made by Clinician.

User Profile

Your profile will be established and maintained for you as a registered user of the Services to enter, store, and access your health information online, and for Clinicians to communicate with you about your care. This may include history, current conditions, symptoms, complaints, allergies and medications. All of the information contained in your profile will be maintained in accordance with our Terms and our Privacy Policy. You agree to provide accurate and complete information and to update information that you provide as needed.

Clinicians may add electronic notes regarding your treatment, such as findings, diagnosis, treatment plan, and any recommendations.

Counseling Sessions are not recorded, however any messaging and communication transmitted through the services may be monitored for quality assurance, training and other purposes. By accepting these Terms you consent to any such monitoring. Messages may be saved to your profile.

Privacy

Please refer to our Privacy Policy. It is recommended that secure electronic messaging is preferred method, however there may be instances where insecure email communication that contains protected health information may take place between you and TOC that is at your discretion. This may include messaging, appointment reminders, any other discussion through the Site and its Third Parties. User is aware that standard email is not a secure means of communication and can be breached at any time by unauthorized third parties. We cannot ensure the security or confidentiality of these message transmissions.

The messaging and communication will be through a secure Patient Portal by a Third Party that is recommended method of usage in order to protect personal health information. This authorization indicates that you agree and accept the risks involved with any unauthorized insecure communication of your Personal Health Information.

You have a right to request no message transmissions with your Clinician, we recommend you have that discussion with the Clinician regarding this and find another method of exchange.

By providing your information and agreeing to these Terms and Conditions, you are giving your consent to leave voice messages at the phone numbers provided by you. Such contact will not disclose details of your personal health information and will be limited to the expected agenda.

Confidentiality

We will protect any information shared between you and the Clinician as the online sessions are not recorded and the Clinician will document electronically in a secured third party site that is only accessed by the Clinician and for quality purposes the Supervisor or administrative staff. Information shared during treatment will not be shared with any unknown party or unauthorized people unless authorized by User.

There are exceptions to this when there are the following disclosed:

  1. If a client threatens or attempts to commit suicide or otherwise conducts him/her self in a manner in which there is a substantial risk of incurring serious bodily harm.
  2. If a client threatens grave bodily harm or death to another person.
  3. If the therapist has a reasonable suspicion that a client or other named victim is the perpetrator, observer of, or actual victim of physical, emotional, neglect, or sexual abuse of children under the age of 18 years.
  4. Suspicions as stated above in the case of an elderly person who may be subjected to these abuses.
  5. If a court of law issues a legitimate subpoena for information stated on the subpoena.

Disclaimer

Your use of the Services, Sites, and related Third Parties in order to receive services are at your sole discretion and risk. All the services, content, materials, information, and transmissions are provided as an “AS IS” basis without any warranties of any kind.

User will hold harmless TOC and Center For Integrated Care Marriage and Family Therapy INC. and its affiliates, employees, contractors, directors, third parties, and representatives from any and all liabilities, losses, fees, claims, and causes of action related to all activities, services not limited to any violation to any of these Terms of Service and violation of any third party.

We do NOT guarantee accuracies, typological errors, services and can refuse services at any time. We do not hold liability and will NOT pay any legal fees related to violation to our Terms, Conditions, Privacy, and Services.

invalid or unenforceable, then the invalid or unenforceable provision shall be removed from the Terms or reformed by the court and given effect so as to best accomplish the essential purpose of the invalid or unenforceable provision, and all of the other provisions of the Terms shall continue to be valid and enforceable. Nothing contained in these Terms of Service shall limit the ability of a party to seek an injunction or other equitable relief without posting any bond. The titles of the Sections of the Terms are for convenience only and shall have no legal or contractual effect.

Conclusion

We reserve the right to change our Terms at any time that will be posted on our Site. Your continued use of our Services and the Site along with Third Party affiliates constitute your agreement to any changes made.
